Article 2 – Scope
1. These general conditions of sale are applicable to all our deliveries and services. These general conditions of sale exclude any other condition on the part of the customer. Deviations from these contractual stipulations are only accepted when we have confirmed them in writing and have been explicitly specified. Only individual customers and “end-user” companies purchasing for purposes other than resale can order on the Elephant Power Records website. Resale or distribution of items purchased on the Elephant Power Records site is strictly prohibited. In addition, for each order that you place on the Elephant Power Records site, you will be asked to accept the general conditions in force at the time of the order. In view of the commercial policy described above, we reserve the right not to act on orders placed by persons other than the end purchaser, or orders which do not comply with our commercial policy as defined here. These general conditions can be modified at any time, especially to accommodate regulatory changes. The new general conditions apply as soon as they are posted on the Elephant Power Records website.
2. In order to place an order, you must be at least 18 years old. If you are not 18 years old, we ask that you consult your parents or guardian before placing an order.
Article 3 – Offers and accord of contracts
1. If an offer is valid for a limited time or is subject to conditions, this is always expressly mentioned in the offer.
2. Our offer contains a complete and precise description of the products offered. The description is detailed enough for you to properly evaluate the offer.
3. Your order will be complete and the contract begins as soon as we have confirmed your order by email and as soon as we have received approval for your transaction from your credit or debit card issuer. We are not responsible for delivery delays and / or non-delivery of your order if these delays are due to the refusal of your payment by your card issuer. No order will be accepted or processed without valid payment in the name of the (registered) cardholder.
Article 4 – Right of withdrawal
1. For any purchase of goods or services, you have 14 calendar days from delivery to withdraw from the contract. During this time you can return your order without penalty and without giving any reason (the return costs are your responsibility). Within 14 days of returning your order, we will refund the full purchase price to you, using the same payment method used by the consumer for the initial transaction.
2. You are therefore responsible for the return costs. We will indicate the exact cost for this return or give an estimate, if it is not possible to predict the exact cost.
3. We may defer reimbursement until recovery of the goods, or until the consumer has provided proof of dispatch of the goods, whichever is the earliest.
4. During the withdrawal period, we advise you to handle the item and the packaging with care, and not to unpack or use it except in so far as this is necessary in order to be able to assess whether you wish to keep the item. If you make use of your right of withdrawal, we ask you to return the good together with all the accessories delivered and in its original condition and packaging, in accordance with our instructions below.
5. You can return your package by post or by courier service with parcel tracking.
6. To execute your withdrawal period, please inform us at this address elephantpowerrecords@gmail.com of the return of the complete or incomplete order BEFORE shipping by informing us of the parcel tracking number.
Article 5 – Price
1. During the period of validity mentioned in the offer, the prices of the goods and / or services offered are not increased, except for price changes following changes in VAT rates.
2. Our prices include all taxes, levies and services. So there will never be any surprises for you. However, we may decide to charge you for the delivery costs. In this case, we will notify you before your order is confirmed.
Article 6 – Payment
1. Payment is limited to the payment methods offered on our Website. Credit Card secured by Stripe or Paypal.
2. To guarantee secure online payment and ensure the security of your personal data, transaction data is encrypted with SSL technology sent over the net. To pay with SSL you do not need any special software. You recognize a secure SSL connection to the “lock” in the status bar of your browser.
Article 7 – Conformity and guarantee
1. We guarantee that our products will be in accordance with your order and meet the normal expectations you may have based on the specifications of the product. We also guarantee that our products meet all applicable laws at the time of your order.
Article 8 – Delivery and execution
1. Deliveries take place at the delivery address provided when ordering.
2. The production of the articles of your order begins after confirmation of your order. If they are visible on the Allens Luxury website, then they can be produced. The usual delivery time is estimated at 3 weeks from your order. This 3 week period is given as an indication. We cannot be held responsible for any additional delay. We make every effort to satisfy you as soon as possible.
3. Deliveries take place every day before noon.
4. Delivery costs vary depending on the destination. They include handling charges and insurance.
• Belgium: €9.50
• France, Germany: €11.60
• Austria, Denmark, Spain, Finland, Ireland, Italy, Portugal: €13,75
• United Kingdom (UK), Switzerland: € 17,15
5. If we cannot deliver on time, we will always notify you before the scheduled delivery date. If we do not notify you in time, you have the right to cancel your order free of charge. In this case, we will refund you within 30 days of the cancellation.
6. The shipment of your order is always at our risk, so you never have to worry about any loss of goods. Returning goods to us within 14 days of purchase because you do not wish to keep them, is done at your own risk.
7. If the goods delivered by us have been damaged in transit, do not match the items on the delivery note, or do not match the items you ordered, you must notify us as soon as possible, within 3 days at the latest, and you must then return the items to us within 14 days of receipt.
Article 9 – Force majeure
1. In the event of force majeure, we are not bound to fulfill our obligations to the other party. In this case, we have the right to suspend our obligations for the duration of the force majeure, or to permanently cancel your order.
2. By force majeure we mean any circumstance beyond our control by which compliance with our obligations towards you is entirely or partially impossible. These circumstances are among others: strikes, lockouts, labor disputes, fire, technical incidents, power failures, disturbances in the networks, (telecommunications) lines or communication systems used and / or not availability of our Website, lack of or late delivery from suppliers or other third parties and lack of authorization to be received via the authorities.
Article 10 – Intellectual property
1. The Buyer expressly acknowledges that all intellectual property rights relating to the information provided, communications or other statements concerning the Products and / or the Website belong to Nicolas Baudoux, its subcontractors or other beneficiaries.
2. The Buyer is prohibited from making use of and / or modifying the intellectual property rights as described in this article, such as for example reproducing them without the express prior written authorization of Nicolas Baudoux, its subcontractors or other beneficiaries.
Article 11 – Complaints procedure
1. We of course always hope that all of our customers are 100% satisfied. Should you still have any complaints, please do not hesitate to contact us at elephantpowerrecords@gmail.com We are committed to dealing with your complaint within 7 days.
2. Belgian law is exclusively applicable to all contracts with our clients, regardless of their place of residence. All disputes that are related to or arise from the offers of Elephant Power Records are subject to the exclusive jurisdiction of the Belgian courts and tribunals. If, for reasons of international law, another law is still applicable, this will be interpreted in the first place in accordance with the Belgian Law on Market Practices and Consumer Protection.
